The terms that govern the use of the Mountly app and services.

These Terms and Conditions of Use ("Terms") govern the access to and use of the application Mountly (the "App") under all its forms (web or mobile), operated by SARL Alexcursion, a company incorporated under the laws of Switzerland, with its registered number CHE 112107332 and office at 23 Grande-rue 1180 Rolle ("we", "us", or "our").

By accessing or using the App, a User ("you") agrees to be bound by these Terms. If you do not agree, you must not use the App.

1. Purpose of the App

The App provides access to various services offered in ski resorts and surrounding areas, including but not limited to: Food delivery, Grocery / essentials delivery, Equipment rental, Local experiences, Paid activities, Local service bookings.

The App is a digital service tool and does not replace parental responsibility, professional judgment, or legal obligations.

The App acts exclusively as a discovery facilitator. The legal service contract is solely between you and the relevant independent third-party ("Supplier"). The App bears no direct liability for the performance of the services or goods provided by the Supplier.

2. Eligibility

  • The App is intended for users aged 18 years or older
  • If the App involves children, only parents or legal guardians may create accounts and provide information relating to minors
  • You confirm that all information provided is accurate and up to date

3. Account Creation

To access certain features, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities carried out under your account.

4. Use of the App

You agree to use the App:

  • In compliance with applicable laws and regulations
  • In good faith and for its intended purpose

You must not:

  • Misuse the App or attempt to disrupt its operation
  • Use the App for unlawful, fraudulent, or harmful activities
  • Attempt to access data or accounts that are not yours
  • Reverse engineer, copy, or exploit the App without authorization

5. Payment and Fees

Certain services available through the App are subject to payment. Prices are displayed in the App before confirmation of any purchase. We reserve the right to modify prices at any time. Price changes do not affect orders already confirmed.

Payments are made directly through the App using the available payment methods (e.g. credit/debit card, in-app payment systems, or other authorized payment providers).

Payments are processed by third-party payment service providers. We do not store any payment card details.

By making a payment, you agree to the terms and conditions of the relevant payment provider.

6. Services and Limitations

We strive to ensure the availability and accuracy of the App but do not guarantee:

  • Continuous or uninterrupted access
  • Absence of errors or bugs
  • That the App will meet all your expectations

We reserve the right to modify, suspend, or discontinue all or part of the App at any time.

6. Third-Party Services

The App may integrate or rely on third-party services (e.g. payment providers, analytics, mapping tools).

We are not responsible for:

  • The availability or performance of third-party services
  • Any issues arising from their use, governed by their own terms and policies

7. Intellectual Property

All content and elements of the App (including text, graphics, logos, software, and design) are owned by or licensed to us.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Any unauthorized use is strictly prohibited.

8. Data Protection

Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.

By using the App, you acknowledge that you have read and understood the Privacy Policy.

9. Liability

To the maximum extent permitted by law:

  • We shall not be liable for indirect, incidental, or consequential damages
  • We are not responsible for decisions made by users based on information provided through the App
  • Our total liability shall not exceed the amount paid by you (if any) in the 12 months preceding the claim

Nothing in these Terms excludes liability that cannot be excluded by law.

10. Suspension and Termination

We reserve the right to suspend or terminate access to the App:

  • In case of breach of these Terms
  • For security or legal reasons
  • If required by law or authorities

You may stop using the App at any time.

11. Changes to the Terms

We may update these Terms from time to time. Users will be informed of material changes via the App or other appropriate means. Continued use of the App after changes means acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. . Any dispute shall be subject to the exclusive jurisdiction of the courts of Rolle, Switzerland, unless mandatory law provides otherwise.
